Not reading or being unaware of these Terms of Service does not excuse non-compliance with them. By commissioning me, you agree to be bound by these terms.


GENERAL TERMS

  • You are responsible for providing clear and accurate references and instructions for your commission.

  • I reserve the right to accept or decline any commission at my discretion, including commissions involving subjects I am not comfortable drawing.

  • I may refuse a commission if the requested content is outside my listed "Will Draw" subjects, beyond my skillset, or otherwise unsuitable for me.

  • By commissioning me, you acknowledge that my artwork is a handmade service and may contain minor variations from the provided references.

  • Please do not commission me if you are not comfortable with my art style. Style changes are not considered revisions.

  • You are responsible for checking the sketch and communicating requested changes within the revision period.

  • Please remain reachable during the commission process.

  • If I require information or approval from you and you do not respond for an extended period of time, your commission may be paused until you return.

  • Please do not repeatedly change your request after work has begun.

REFERENCES & COMMISSION DETAILS

  • You must provide clear references for both the character(s) and what you want me to draw. (example: character reference, desired pose, expression, outfit, background, etc.)

  • Please provide all important information before I begin the commission.

  • If you have a specific vision for the artwork, please communicate it clearly beforehand. I cannot guarantee that I will be able to reproduce a description that is too vague or lacks sufficient references.

  • If you are commissioning a character based on written information alone, I will have creative freedom over visual details that were not specified.

  • Once the commission has started, new major elements cannot be added after the sketch. All necesary changes can only be made on the sketch phase.

PAYMENT

  • I currently accept: Paypal - Ko fi - VGen

  • If you would like to use another payment method, feel free to ask. I may be able to accommodate it depending on the method and circumstances.

  • Payment must be made in the agreed currency and through the payment method agreed upon.

  • Unless otherwise agreed, my standard payment schedule is: 50% upfront > Commission begins > Sketch approval > Remaining 50% > Final artwork

  • The commission will not begin until the first payment has been received.

  • The final high-resolution artwork will not be delivered until the remaining balance has been paid in full.

  • Please do not send payment before your commission has been officially accepted and I have provided you with the appropriate payment information.

  • Any payment processing fees, conversion fees, or other transaction costs are the client's responsibility when applicable.

REFUNDS & CANCELLATIONS

  • No refunds will be issued once the commission has been completed and delivered.

  • If you wish to cancel your commission, please contact me as soon as possible.

  • If I am unable to complete your commission for any reason, I will contact you and discuss an appropriate solution. If I cancel the commission myself, you will receive a refund.

  • Do not issue a chargeback or payment dispute without contacting me first. Unauthorized chargebacks or disputes after payment may be treated as a breach of these Terms of Service.

  • Refunds, when approved, will normally be issued through the same payment method originally used, when possible.

SKETCH & REVISIONS

  • A sketch will be provided for approval before I move on to the lineart/rendering stage.

  • Please make sure to communicate all desired changes while reviewing the sketch.

  • Major changes requested after sketch approval may require an additional fee IF i accept them.

  • Minor corrections caused by my own mistake will, of course, be corrected without additional charges.

  • Revisions are intended to correct or adjust the agreed-upon commission, not to completely redesign the artwork after approval.

  • Please take your time when reviewing the sketch. Once you approve it, I will consider the composition and major elements finalized.

DEADLINES & WORK PROCESS

  • Commissions are completed according to my current queue and availability.

  • I will provide an estimated completion timeframe when appropriate, but estimated deadlines are not guaranteed unless a specific deadline has been agreed upon beforehand.

  • If I expect a significant delay, I will do my best to inform you.

  • If you require the artwork by a specific date, please tell me before commissioning me. Rush commissions may be accepted depending on my availability and may require an additional fee.

  • Please understand that commissions are not necessarily completed on a first-paid, first-finished basis. My workflow may vary depending on the type and complexity of each commission.

INTELLECTUAL PROPERTY & COPYRIGHT

  • I retain the copyright to the artwork I create unless a separate written agreement states otherwise.

  • Purchasing a commission does not automatically transfer copyright ownership to the client.

  • You receive personal rights to use the finished artwork for non-commercial purposes, unless otherwise agreed.

  • You may: Use as profile picture, banner, wallpaper, etc - Post the artwork on social media WITH CREDIT - Print the artwork for personal use (posters, pins, etc).

  • You may not: Claim the artwork as yours - Remove my sighnature and watermark - Sell, redistribute, or resell - Use the artwork for commercial purposes without permission - Use the artwork to train, develop, or promote AI models/generators - Mint, sell, or use the artwork as an NFT - Heavily edit the artwork and present the modified version as your own work - Use the artwork in merchandise or products for profit without a commercial license.

  • Commercial use is not included in the standard commission price. This includes, but is not limited to: merchandise, products for sale, advertising, branding, company/business use, moneticed/paid content, book or album covers, promotional material, commercial social emdia use, use in games, apps, or other commercial projects.

ARTIST RIGHTS

  • I retain the right to display completed commissions in my: portfolio, website, social media, art galleries, commission examples, promotional material.

  • If you require your commission to remain private, please tell me before commissioning me.

  • I may post the finished artwork after delivery unless a prior privacy agreement has been made.

  • I reserve the right to sign or watermark my artwork.

  • Requests to imitate another artist's style may be declined.

CREDIT AND THIRD PARTY RIGHTS

  • Please credit me using my current artist name/handle where possible.

  • If you are unable to provide visible credit due to the platform or format, this is generally fine, but please do not claim the artwork as your own.

  • If you commission me to draw a character that you do not own, you are responsible for ensuring that you have the necessary permission to request artwork of that character when applicable.

  • For fanart, I retain the copyright to my artwork, while the original copyright/trademark rights of the character remain with their respective owner.

  • Commissioning artwork of your original character does not automatically transfer ownership of the character to me. The client retains their existing rights to their character.

DELIVERY

  • Final artwork will be delivered digitally in the agreed format and resolution.

  • The final files will be delivered after the commission has been completed and the remaining payment has been received.

  • Unless otherwise agreed, I will provide the artwork as a standard digital image file such as PNG or JPG.

  • If you require a specific file format, please ask before the commission begins.

FINAL NOTES

  • These Terms of Service may be updated from time to time. The version accepted at the time of commissioning will apply to that commission.

  • Any exceptions to these Terms of Service must be agreed upon in writing before the commission begins.

  • If you have any questions or are unsure whether your commission falls within my boundaries, please ask before purchasing. I would rather clarify something beforehand than have an issue later.

  • By commissioning me, you confirm that you have read, understood, and agreed to these Terms of Service.
